Nebraska Motorcycle Helmet Law LB138 – Effective January 1,2024

 LB138 repeals the state of Nebraska’s motorcycle helmet law.

 As of January 1, 2024, persons MAY legally ride without a helmet by meeting the following criteria:

  1. Age 21 years or older. 
  2. Wear eye protection while riding. 
  3. Have successfully completed a Basic Motorcycle Safety Course.  Any of the following courses will meet the “Basic Motorcycle Safety Course” language in this new statute. 
      • Basic Rider Course (BRC) 
      • Basic Rider Course 2 (BRC2) 
      • Returning Rider Basic Rider Course (RRBRC) 

The Nebraska Motorcycle Safety Training Program and the Motorcycle Safety Foundation recommend wearing a helmet, as proper helmet use has been shown to reduce the risk of brain injury by 67% and the risk of death by 37% (U.S. Department of Transportation).
